Attention: All District Human Resources and Social Security Bureaus and all relevant units:

We hereby promulgate the Implementation Rules of Shanghai Municipality for Introduced Talents to Apply for Permanent Household Registration in Shanghai to you in accordance with the Notice of Shanghai Municipal People’s Government on Issuing the Procedures of Shanghai Municipality for Introduced Talents to Apply for Permanent Household Registration in Shanghai (SHHRSS D [2020] No. 25) for your compliance and implementation.

Implementation Rules of Shanghai Municipality for Introduced Talents to Apply for Permanent Household Registration in Shanghai

These Implementation Rules are formulated in order to put in place the Notice of Shanghai Municipal People's Government on Issuing the Procedures of Shanghai Municipality for Introduced Talents to Apply for Permanent Household Registration in Shanghai (SMPG D [2020] No. 25, hereinafter referred to as the Procedures),

I. Applicable Objects

1. These Rules shall apply to the introduction of domestic outstanding talents by institutions that are registered in the administrative area of this Municipality, conduct normal operations and pay taxes in accordance with the law, and meet one of the following conditions:

(1) units with independent legal status;

(2) the first-level branch of the organization stationed in Shanghai and affiliated to the central government, and the branch of headquarter stationed in Shanghai;

(3) other branches recommended by regional or competent industry authorities; and

(4) branches that really need to introduce talents in line with Item 14 of Paragraph 4 of Article 5 of the Procedures.

The introduction and settlement of other special administrative personnel such as demobilized military cadres who independently choose jobs shall be implemented in accordance with the provisions of relevant departments or documents.

II. Conditions for Application

1. The employing unit shall sign labor (employment) contracts with the talents who have been introduced, and pay social insurance premiums in Shanghai Municipality according to law. The introduced talents generally should be at least 5 years away from the legal retirement age. For those that are particularly excellent or in urgent need, the age requirement may be appropriately relaxed. The working place of the introduced talents should generally be in Shanghai.

2. The "qualifications for senior professional technical posts" as mentioned in Item 1 of Paragraph 1 of Article 5 of the Procedures refers to holding the senior professional titles with employment at corresponding posts in accordance with relevant provisions, including the national vocational qualifications defined to be employed at corresponding senior professional titles.

3.The "awards by provincial and ministerial level governments or above "as mentioned in Item 2 of Paragraph 1 of Article 5 of the Procedures refer to the science and technology awards at or above the provincial level or the government awards co-granted by the people's governments at or above the provincial level or national human resources and social security ministry, in conjunction with the relevant ministries and commissions that grant the winners the treatment and benefits at or above the provincial and ministerial level with personal certificate being provided. Government commendation projects shall be identified by the departments in charge of government commendation. Generally, the employing unit can apply for the introduction of the talents within 5 years after they are awarded.

4. The identification basis of "candidates listed in the personnel cultivation plan at provincial or ministerial level or above" as mentioned in Item 3 of Paragraph 1 of Article 5 of the Procedures shall refer to the approval of the relevant national competent department or the people’s government or competent personal department in provinces, cities or autonomous regions. Generally, the employing unit can apply for the introduction of the talents within 5 years after they are included in the talent cultivation plan.

5.The "major national science and technology special projects, national key research and development projects and municipal major science and technology projects" as mentioned in Item 4 of Paragraph 1 of Article 5 of the Procedures refer to the science and technology projects identified in line with the approval of the national or municipal competent department of science and technology; the "project leader and core team members" shall be identified by the national or municipal competent department of science and technology in line with the project approval and application materials. Within the execution period of the project, the employing unit can apply for the introduction of the project leader and the core team members.

6. The "key organizations" as mentioned in Paragraph 2 of Article 5 of the Procedures include the high and new technology enterprise, the units undertaking transformation projects of new and high technology achievements, research and development centers with the qualifications of independent legal status, invested and set up by regional headquarters of  multinational corporations in Shanghai, trade-type headquarters and their regional headquarters, key talent- employing units recommended by the municipal key industry areas, key zones, (including the university science parks at national level in this Municipality that have remarkable results in achievements transference).

"New and high technology enterprises" and "transformation projects of new and high technology achievements" shall be identified by the Municipal Science and Technology Commission. "Regional headquarters and trade-type headquarters of multinational corporations" shall be identified by the Municipal Commission of Commerce. Where transformation project of new and high-tech achievements is in normal operation and within the term of validity, the employing unit can apply for the introduction of project personnel.

The talents introduced in accordance with Item 5 of Paragraph 2 of Article 5 of the Procedures shall have at least 1 year of relevant working experience (up to the date of application). The talents introduced in accordance with Item 6 and 7 of Paragraph 2 of Article 5 of the Procedures shall be the core business backbones that are urgently needed by the unit and have more than 2 years of relevant working experience (up to the date of application).

7. The talents introduced in accordance with Item 8 and 10 of Paragraph 3 of Article 5 of the Procedures shall have personal award certificates, and the employing unit can generally apply for introduction within 5 years after the person has won the honor (award).

The "high skillful talents of technical category" as mentioned in Item7 of Paragraph 2 of Article 5 of the Procedures as well as in Items 9 and 10 of Paragraph 3 of Article 5 of the Procedures refer to the high skilled professionals engaged in the technical occupation, work in the front line (specific occupation, type of work scope shall be separately published) or recommended by the competent department of industry and self-evaluated and recommended by the leading industrial enterprise.

"Skills competition awards at or above national, provincial or ministerial level " refer to the national or provincial or ministerial level skills talent commendation, gold, silver, bronze awards at national level skills competition or gold (or first prize) award or above at provincial or ministerial level skills competition.

8.The "entrepreneurial talent and core team members that has obtained certain scale of venture capital" as mentioned in Item 11 of Paragraph 4 of Article 5 of the Procedures refer to the entrepreneurial talents that obtained the first round of venture investment of 10 million yuan RMB or above from the science and technology business incubators (have to be put on record by Shanghai Science and Technology Enterprise Incubator Association) or from venture investment institutions (have to be put on record by Shanghai Venture Capital Industry Association) or first-round venture investment up to 10 million yuan RMB or above or holding not less than 10% shares of the enterprises in this municipality that has accumulated venture investment up to 20 million yuan RMB or above (have to be put in place with continued investment full 1 year), and keep working in the enterprise for 2 years.

9. The " innovation and entrepreneurship intermediary service talents and core team members that have obtained significant achievements tested by the market in this Municipality” as mentioned in Item12 of Paragraph 4 of Article 5 of the Procedures refer to the first technical contract completer that has engaged in continuous technology transfer and transformation of scientific and technological achievements for full two years in service in this Municipality (have to be put on record by Shanghai Technology Transfer Association) and achieved a total of 50 million yuan RMB or above of technical transaction volume in recent 3 years (The parties to the technology contract shall have no less than 5 non-affiliated enterprises respectively, and the performance rate of the technology contract shall reach 70% or above).

10. The "venture capital management and operation talents and core team members that have venture capital funds managed and operated in this Municipality with a certain scale and remarkable performance tested by the market” as mentioned in Item 13 of Paragraph 4 of Article 5 of the Procedures refer to the partners of venture investment institutions in this Municipality with the completed investment of 30 million yuan RMB or talents with the position of vice president or above in senior management

11. The " science &technology talents and skilled personnel for enterprises with remarkable level of market value" as mentioned in Item 14 of Paragraph 4 of Article 5 of the Procedures refer to the senior management, science & technology talents and skilled personnel in the enterprise, whose accumulative base of social insurance premiums paid for the total 36 months in the recent 4 years is 3 times of the average salary of urban employees last year in this Municipality, and the accumulative individual income tax paid reaches 1 million yuan RMB.

12. The "entrepreneurial talents with remarkable business achievements" as mentioned in Item 15 of Paragraph 4 of Article 5 of the Procedures refer to entrepreneurs who simultaneously meet the following conditions:

(1) The legal representative (chairman of the board or general manager) who operates the municipal enterprise or the founder who holds no less than 10% of the shares.

(2) The profit rate of operating income shall be above 10% for three consecutive years, and the tax payable in the previous year shall not be less than 10 million yuan RMB; or a high-tech enterprise whose main business income has increased by more than 10% annually for three consecutive years, and whose tax payable in the previous year is not less than 10 million yuan RMB; or enterprises listed in Shanghai Stock Exchange, Shenzhen Stock Exchange and other capital markets.

The manufacturing technique, equipment and products of the enterprise do not belong to the restricted or eliminated categories prescribed by the State and this Municipality.

No major violations of laws and rules and no trust-breaking information records.

13.  The "professionals in shortage and urgent need for the shipping, traditional culture and art, sports, medicine, agricultural technology and the other special industries" as mentioned in Item 16 of Paragraph 5 of Article 5 of the Procedures refer to the talents recommended by the competent authorities of the industry through evaluation and assessment by peer experts as well as the specialized talents with relevant professional qualification certificates assessed by the competent department of industry. The scope is as follows:

(1) Shipping professionals

A. Divers that are engaged in diving operations, with a national saturation diver certificate or air diver certificate.

B. Captains that are engaged in ocean-going vessel navigation, with Certificate of Competency for Master of Class A Vessel

C. Test pilots that hold airline transportation pilot license with relevant flight experience or military aircraft test flight experience, and are engaged in the corresponding work.

D. Pilots that have obtained a pilot's license and are engaged in corresponding work.

E. Personnel that have civil aircraft maintenance license and flight assignment license and are engaged in corresponding work.

(2) Talents of traditional medicine

The talents of traditional medicine recognized by the provincial health administration department and granted with the title of "Mater of National Medicine" or "Famous TCM Doctor" conferred by the provincial healthcare administration department.

(3) Sports professionals

Specialized sports talents recognized by the Municipal Sports Bureau and awarded in important international or national sports events.

(4) Cultural professionals

Specialized cultural talents recognized by Municipal Publicity Department and awarded with international or national important literary and cultural awards.

14. The "talents in shortage and urgent need self-approved by districts and key areas of this Municipality " as mentioned in Item 17 of Paragraph 5 of Article 5 of the Procedures refer to the personnel that are not in conformity with Item 1 of Paragraph 1 to Item 16 of Paragraph 5 of Article 5 of the Procedures, but are self-approved and introduced by the districts and key areas of this Municipality through the decision-making process of examination and publication.

15. The employing unit may apply to the competent department of the industry for introducing other talents with special skills who are in short supply and urgent need. The competent department of the industry shall organize peer experts to evaluate the performance and contribution of the introduced talents and issue evaluation and recommendation opinions. The municipal human resources and social security department shall, according to the recommendations put forward by the competent departments of the industry, organize regular meetings for collective discussion and evaluation.

III. Application Materials

Those who can verify relevant application materials information by calling electronic certificates and data sharing through the "Integrated Online Platform" system of this Municipality may be exempted from submitting paper application materials.

1. "Personal valid identity certificates and household registration certificates" as mentioned in Paragraph 2 of Article 6 of the Procedures refer to the resident identity card, household registration booklet or household registration certificate issued by the public security department of the place where the household registration is located; marriage certificate or marital status certificate issued by the civil affairs department of the locality of the household registration; a divorce agreement or court mediation (judgment) shall be provided at divorce or remarriage; where the case involves minor children, the attribution of custody of those children should be clearly defined. The "Qualification certificates for professional technical posts or Certificate of Vocational Qualification" refers to one of the following materials:

(1) senior professional title certificate, assessment statement obtained through the examination and assessment and the employment certificate of the employing unit;

(2)  where a senior professional is hired in an industry (unit) through employment instead of assessment in accordance with the provisions, the employment certificate shall be provided; or

(3)  national vocational qualification or skill level certification of level 2 or above that can be checked and verified through the “national network query system for skillful professional evaluation certificate" or the special column of "Shanghai Vocational Skill Appraisal" on the website of Shanghai Human Resources and Social Security Bureau.

2. The "voucher paid for social insurance premium and individual income tax during employment period according to law" as mentioned in Paragraph 3 of Article 6 of the Procedures refers to the scenario that the applicant shall lawfully participate in social insurance of this Municipality pay taxes, and social insurance premium and individual income tax payment shall be checked by the handling department while individuals are exempt from submission.

3. The "property ownership certificate or the housing-renting certificate of the tenant himself or the unit or relative that accepts the settlement" as mentioned in Paragraph 5 of Article 6 of the Procedures refers to one of the following materials:

(1) The real estate property certificate of the introduced talents or their spouse in Shanghai or the certificate of renting public housing;

(2) For the introduced talents who settle down in the households of their direct family members in this Municipality, they should provide the identity relationship certificate with their direct family members, the real estate property certificate of their residential housing in Shanghai or the certificate of renting public housing, the household registration booklet of their direct family members and the settlement-approval documents signed by all the registered persons in the household registration booklet; or

(3) For the introduced talents who live in talent apartments or staff dormitories, they should provide copies of the corresponding collective household registration booklet or household registration certificate, as well as settlement-approval materials; those who do not have any of the above-mentioned conditions can apply to settle down in public households in the community.

IV. Submission of Application

The application prescribed in Article 7 of the Procedures shall be handled in the following ways:

1. After verifying and preparing the relevant materials of the unit and individual, the employing unit shall submit the application through the "Integrated Online Platform" system of this Municipality.

The units stationed in Shanghai that are affiliated to the central government as well as the municipal units therein shall apply to the handling agencies of the municipal human resources and social security department; other units shall apply to the district human resources and social security department in the place of registration or the relevant authorized departments.

2. Personnel dispatched by intermediary agencies generally are not within the scope of application. Where an institution of education, public health or scientific research in this Municipality implements personnel dispatch due to staffing reasons, the institution that actually hires employees shall, through recommendation and filing by the competent department of the industry, submit an application for personnel introduction.

V Application Handling Process

Application of introduced talents for permanent residence in this Municipality shall be handled in accordance with the following procedures:

1. After receiving the application materials through the "Integrated Online Platform" system, the municipal handling organs shall conduct the pre-examination, make one-time notification for the applicant to complete the relevant materials if they are incomplete, and pass the pre-examination if they are complete and valid, and inform the employing units to submit written materials on the spot. The human resources and social security department or the relevant authorized department shall complete the preliminary examination within 5 working days after the on-site acceptance.

2. The municipal human resources and social security department or the relevant authorized departments shall complete the examination and verification of the materials that have passed the preliminary examination within 10 working days in accordance with the provisions.

3. After the examination and approval, the information of the eligible personnel shall be published on the relevant government website for publicity and social supervision. The publicity period is 5 days.

4. If there is no objection in the publicity, the municipal human resources and social security department shall send the verification information to the municipal public security department through data sharing. Relevant personnel shall handle household transfer procedures in accordance with the requirements of the municipal public security departments.

VI. Family Members Trailing the Transfer and Relocation

The "minor children" as mentioned in Article 12 of the Procedures refer to children under the age of 16 and children at/over the age of 16 who are studying in regular senior high schools. If a minor child trails the relocation, his or her medical birth certificate and household registration certificate shall be provided. Regular senior high school students at/over the aged of 16 trailing the relocation shall provide additional student status proof.

A spouse trailing a transfer (or relocation) shall provide the social insurance certificate in Shanghai (or retirement or unemployment certificate), valid identity certificate and household registration certificate. If an adopted child of the introduced talents trails the relocation, the case shall be handled in accordance with the provisions of the municipal public security department.

VII Credit Supervision Mechanism

The system of notification commitment and the system of trust-breaking list shall be implemented in introduction of talents. The unit or individual shall make a written commitment to the authenticity for the information filled in and for the electronic and written materials submitted, and it is strictly prohibited to conceal or falsify. Once the unit or individual is found to provide false or forged materials, it shall be listed in the trust-breaking list and, depending on the seriousness of the circumstances, the qualification of the unit or individual for reapplication shall be suspended or even cancelled.

If the circumstances are especially serious, the relevant information shall be incorporated into the Shanghai Municipal Public Credit Information Service Platform.

VIII Household Registration Cancellation

The permanent residence registered in this Municipality that has been obtained by deception shall be cancelled in accordance with the relevant provisions of the State and this Municipality.

IX Other Matters

1.The social insurance for the introduced talents whose household registration has settled in this Municipality shall be implemented in accordance with the relevant provisions of the State and this Municipality.

2.These Implementation Rules shall be effective as of December 1, 2020 and remain valid until November 30, 2025
