With the approval of the Municipal People’s Government, the Procedures of Shanghai Municipality on the Construction and Management of Electric Vehicle Charging Facilities in Residential Quarters are hereby issued to you for your earnest implementation.

Procedures of Shanghai Municipality on the Construction and Management of Electric Vehicle Charging Facilities in Residential Quarters

Chapter I  General Principles

Article 1 (Purpose and Basis)

These Procedures are formulated in accordance with the essence of the New Energy Vehicle Industry Development Plan (2021-2035) (SC G [2020] 39), the Implementation Opinions on Further Improving the Service Supporting Ability of Electric Vehicle Charging Infrastructure (DRE D [2022] 53), the Implementation Opinions on Further Promoting the Construction of Charging and Swan Infrastructure in This Municipality (SMPG GO G (2022) No. 1) and other documents to standardize the construction and management of electric vehicle charging facilities in residential quarters of this Municipality.

Article 2 (Scope of Application)

These Procedures are applicable to guiding the construction and operation management of charging facilities in residential quarters.

Residential charging piles include self-built piles and public piles. Self-built piles refer to the charging facilities built by residents themselves for personal use. Public piles are charging facilities that engage the charging operators to participate in the construction and are shared by the residents of the residential quarters.

Article 3 (Basic Principles)

We shall, in accordance with the principle of "government guidance, market participation, and multi-party collaboration", put in place the territorial duties of each district and the leading responsibilities of functional departments, fully mobilize the enthusiasm of charging operators, coordinate and facilitate the construction of charging facilities in residential quarters.

As for residential charging facilities, it is necessary to standardize the operation and maintenance management, improve the charging safety supervision system, actively promote the application of intelligent and orderly charging, and accelerate the formation of a residential charging network that features "slow – based charging, safe and intelligent, economical and convenient, and open and sharing", so as to create good conditions for residents to use new energy vehicles.

Chapter II  Reservation of Charging Conditions for New Residential Quarters

Article 4 (Construction Reservation Requirements)

All allocated parking spots in the new residential quarter shall implement the installation and use conditions of charging facilities in accordance with the relevant requirements of this Municipality.

Article 5 (Design and Audit Requirements)

When designing the scheme and organizing the design of the construction drawings, the development unit shall, in accordance with the technical requirements of the State and this Municipality concerning the conditions for the construction and installation of parking spaces reserved for charging facilities in new residential quarters, put in place such construction and installation conditions of the parking space reserved for charging facilities. When reviewing the design document, the construction drawing institution shall review whether the installation conditions reserved for charging facilities meet the requirements.

Article 6 (Operation and Maintenance Management Duties)

After the construction of the charging piles and related supporting projects in new residential quarters, all relevant parties should continue to engage in good follow-up management, operation and maintenance.

The project constructed by the power department shall be incorporated into implementation of the new residential power supply supporting project, be subordinate to the jurisdiction of the power department, and be managed and operated and maintained by the power department at later-stage period.

For projects constructed by development units (except charging piles), their later-stage management, operation and maintenance shall be implemented in accordance with other affiliated public supporting facilities of the residential quarter.

The charging piles installed in place should be managed and maintained by the owner, and charging operators, property service enterprises and other relevant units can be entrusted with the management and maintenance.

Chapter III  Self-built Piles in Residential Quarters

Article 7 (Responsibility for Safety Management)

The self-built piles shall be constructed, managed and be in charge of by the owner himself, who shall bear the main responsibility of safety management.

In case the safety risks are found in the daily inspection, property service enterprises shall remind the owner of self-built pile to perform safety management responsibilities.

Article 8 (Construction Process)

Before constructing and installing self-built piles, residents shall inform the property service enterprise in writing.

Where the self-built pile is built on a parking spot with own property right or on a rental parking spot with the consent of the property owner (the effective rental period is one year or more), the property service enterprise shall cooperate with the power department to carry out a site investigation after receiving the written notification from the residents, determine the installation position of the relevant distribution box and meter box, and assist in providing relevant drawings and data, and cable access conditions.

If the self-built pile is built on the parking space shared by all the owners (the effective rental period is one year or more), it shall be approved and confirmed by the owners' meeting or the owners’ committee authorized by the owners' meeting.

Article 9 (Power Capacity Increase)

When the remaining power conversion and distribution capacity of the residential quarter is insufficient, the power department shall be responsible for the capacity renovation increase for the residential quarter. After the agreement and confirmation of the owners' meeting or the owners’ committee authorized by the owners' meeting, the property service enterprise shall cooperate with the power department to carry out the site investigation and construction, and provide the relevant drawings and data and the installation position of the power distribution equipment and the meter box, and the cable channel (bridge) and other power access conditions.

Article 10 (Fire Control Requirements)

Where the self-built pile needs to be installed in the garage of the residential quarter, the garage shall be equipped with fire-fighting facilities in accordance with regulations. .

It is encouraged for some old garages to install local application systems of automatic sprinkler, set up independent fire and smoke detection and alarm devices with networking functions and improve fire fight safety.

Article 11 (Accompanying piles)

When residents purchase new energy vehicles, electric vehicle production (sales) enterprises that provide residents with accompanying piles and installation services shall confirm the service content and charge details to users before construction, and be responsible for the quality and safety during the warranty period.

Article 12 (Liability for Restoration)

When the self-built piles need to be dismantled or relocated, the owner shall apply to the power department for electricity account cancellation and bear the responsibility for restoring the original state. At the same time the owner shall inform the property service enterprises, which shall engage in cooperation.

Chapter IV  Public Charging Piles in Residential Quarters

Article 13 (Public Piles Construction)

The public charging piles may be built by using a part of the pubic parking space and be shared by all owners for common use; they may also be planned, constructed and operated in accordance with the "unified construction and management" mode to coordinate the overall charging needs of the residential quarter.

If the owners' meeting or the owners’ committee authorized by the owners' meeting votes to carry out the construction of public piles in the residential quarter, the owners' meeting in the residential quarter shall sign a contract or agreement with the charging operator.

The residential quarter that fails to elect the owners’ committee due to objective reasons shall implement the construction of charging piles after the neighborhood committee solicits the opinions of the owners.

Article 14 (Power Capacity Increase)

Charging operators should carry out public piles construction in an intelligent and orderly way to make full use of the residual power transformation and distribution capacity of the residential quarter.

Where the power transformation and distribution capacity of the residential quarter still cannot meet the construction requirements under the intelligent and orderly charging mode, the charging operator can apply to the power department for the transformer capacity increase for the residential quarter.

After the approval and confirmation by the owners' meeting or the owners’ committee authorized by the owners' meeting, the property service enterprise shall coordinate in providing the installation position of the power distribution equipment, cable channel (bridge), meter box position and other power access conditions required for the capacity increase.

Article 15 (Fire Control Requirements)

Where public piles need to be installed in the garage of the residential quarter, the garage should be equipped with automatic fire alarm system, automatic fire extinguishing system, smoke exhaust facilities, fire emergency lighting, evacuation indication signs and other necessary fire facilities, be equipped with fire extinguishers and other fire - fighting equipment.

Article 16 (Operation and Management)

When the project is powered on after completion, the charging operator shall organize the overall acceptance, and retain the relevant information for future reference.

Charging operators shall perform the responsibility as subject of public pile safety production, responsible for daily maintenance and management, purchase charging safety liability insurance for the charging piles of own operation and assume the corresponding safety management responsibilities.

When providing paid services, the charging operator shall clearly mark the price and carry out periodic compulsory verification of the charging piles in accordance with the law.

Article 17 (Object of Utilization)

Public charging piles built on the public parking space shared by all the owners shall be used by all owners of the residential quarter.

After the public piles construction is introduced to the residential quarter, the charging pile self-built may be entrusted to the charging operator for unified management through negotiation.

For the parking spots owned by residents with property right or personal rental parking spots that cannot be constructed for self-built piles, residents can negotiate with the charging operator and sign a contract or agreement to open charging piles for personal use in line with the "unified construction and management" mode of the residential quarter, and be encouraged for sharing at different times .

Article 18 (Parking Spots Management)

The charging operator shall, after consultation with the owners' meeting, specify in the contract or agreement the daily management and coordination on the parking spots where public construction piles are used by all owners.

It is encouraged to apply the market price approach, intelligent devices and other technical means to avoid parking spaces from occupation by non-charging vehicles.

Article 19 (Liability for Restoration)

Where it ceases to operate after the expiration of the agreement, the charging operator shall dismantle the relevant facilities and equipment, restore it to its original state, and apply to the power department for account cancellation.

Chapter V  Interconnection and Sharing of Charging Piles in the Residential Quarter

Article 20 (Orderly Charging)

The newly self-built piles and public-built piles in residential quarters should be in conformity with the relevant requirements for the intelligent charging piles and meet the orderly charging and power demand response.

Article 21 (Charging Piles Sharing)

The sharing of charging piles in the residential quarter shall be in conformity with the relevant management requirements of this Municipality, and the charging operators shall be entrusted by the owners or users of charging piles for intelligent charging management and open sharing.

Article 22 (Users of Sharing)

The sharing users of the charging pile in the residential quarter should be the dwellers of this residential quarter, and the authorization management of the sharing users can be conducted by adding into a white list.

Article 23 (Multi-Party Participation)

Charging operators are encouraged to entrust property service enterprises to participate in the daily management of the charging piles open sharing in the residential quarter through market-oriented approach.

Each participant shall agree on the distribution mode of the incomes from charging service.

Chapter VI  Electric Power Supporting Services

Article 24 (Scope of Electric Power Supporting)

The power department is responsible for connecting charging facilities from the property rights demarcation point to the public grid.

Article 25 (Electricity Price)

The electricity price for self-built piles and public piles applied for independent installation in residential quarters shall be subject to the average price of residential electricity. Charging operators shall take charging service fees in accordance with the relevant provisions of the pricing department.

Article 26 (Application for Self-installation)

When applying for independent installation of self-built piles, residents shall submit an independent application form as required by the power department, and provide the following materials:

1.The applicant's identity document;

2.New energy vehicle sales and purchase vouchers (the applicant's own car purchase contract or car purchase invoice);

3.Where the pile is built on the parking space with the personal property rights, the applicant shall provide the certificate of fixed property rights of the parking space as well as the stamped receipt of written notification on self-built pile;

4.Where the pile is built on the parking space with the leased property right, the parking space rental certificate with a validity period of one year (including) or more, as well as the consensus to the construction by the property owner and the stamped receipt of written notification on self-built pile shall be provided; and

5.For the construction of a parking space shared by all the owners, the parking space rental certificate with a validity period of one year (including) or more and the materials approved by the owners' meeting or the owners’ committee authorized by the owners' meeting shall be provided.

The power department shall provide the sample template of the relevant materials at the service window, and shall, after receiving the application, start the site survey in accordance with the principle of "one pile for one vehicle " in a timely manner.

The applicant and the property service enterprise shall work together to confirm the installation position of the meter box.

The power department shall connect power after the completion of installation of charging facilities, and may conduct billing and settlement by prepaid card form.

Article 27 (Application for Public Installation)

When applying for independent installation of public piles, the charging operator shall provide a contract or agreement signed with the owners' meeting of the residential quarter.

Chapter VII  Safeguards Measures

Article 28 (Coordination Mechanism)

This Municipality shall establish a three-level linkage working mechanism of "municipal overall planning, district organization, subdistrict and township implementation" to clarify the division of responsibilities for various departments.

Each district, town/township (subdistrict), village (residential) committee should effectively implement the territorial subject responsibility, clearly define the responsible department of residential charging pile construction, and coordinate the construction of self-built piles and public piles in the residential quarter.

Article 29 (Departmental Responsibilities)

Relevant departments at all levels of this Municipality shall, in accordance with the division of responsibilities, closely cooperate in the management, guidance and promotion of the construction of charging infrastructure in residential quarters.

1.The development and reform department is responsible for formulating supportive policies to support the development of charging piles in the residential quarters and guiding the sharing of charging piles.

2.The housing and urban-rural development department is responsible for the review and acceptance of the reserved installation conditions of charging facilities for new residential projects, and shall incorporate it into the supervision of project quality acceptance.

3.The department of economy and information technology is responsible for urging electric vehicle production (sales) enterprises to implement the construction responsibility of intelligent charging piles.

4.The housing management department is responsible for guiding property service enterprises to cooperate with the construction and management of charging piles in residential quarters.

5.Fire fighting departments and public security police stations shall, in accordance with laws and rules, carry out daily fire control supervision and inspection on fire control safety management of residential properties in their jurisdiction as well as on the performance of fire control safety responsibilities.

6.District people’s governments shall take in charge of supervising the departments of the town/township (subdistrict) in the jurisdiction that are responsible for the construction of charging piles in the residential quarter, and coordinate the construction of self-built piles and public piles in the residential areas.

7.The town/township (subdistrict) and village (residential) committees shall specifically conduct good guiding and supervising over the owners' committees and property service enterprises, engage in backstop services and management for some residential quarters without owners' committees or property service enterprises, and coordinate the specific problems that occur during the construction of charging piles in the residential quarter.

8.The power department is responsible for the installation and power-connection of charging piles, and for guiding charging operators in an orderly charging and interactive response to ensure that residents charge normally.

9.The municipal charging platform is responsible for providing services for the charging pile access platform built by electric vehicle production (sales) enterprises as well as charging operators, and promoting the sharing of charging piles.

10.Electric vehicle production (sales) enterprises and charging pile production and sales enterprises are responsible for the product quality of the self-built piles provided by them, and for the quality and safety of charging facilities during the warranty period.

11.The charging operator is responsible for the construction, acceptance, operation and maintenance of public construction piles in the residential quarters, and for the daily maintenance and safety of the facilities.

12.The property service enterprise is responsible for coordinating with residents and charging operators in carrying out construction of self-built piles and public piles, and cooperating with the power department to carry out power capacity increase and meter installation for residential quarters.

Chapter VIII  Implementation Date

Article 30 (Date of Implementation)

These Procedures shall be effective as of June 1, 2023 and be valid until May 31, 2028.
