Shanghai Intellectual Property Administration
Main responsibilities are as follows:
1. Implement laws, regulations, rules, guidelines, and policies related to trademarks, patents, and geographical indications of origin. Conduct research and draft local regulations, rules, and policies concerning trademarks, patents, and geographical indications of origin. Organize the implementation of these regulations and policies once adopted.
2. Collaborate with relevant departments to formulate the IP strategy outline for Shanghai. Ensure the implementation of the strategy outline in accordance with the national IP strategy and the overall objectives and requirements for establishing Shanghai as an IP powerhouse. Draft IP development plans and work plans, and organize their implementation. Provide guidance and supervision for the implementation and assessment of district-level IP strategies within its authority.
3. Promote the construction of an IP protection system and coordinate the implementation of IP protection measures. Conduct research and encourage the development of IP protection, management, and service policies for innovation in new fields, businesses, and models. Collaborate with relevant departments to carry out IP protection in key fields, pillar industries, major special projects, and IP inspection in critical economic activities. Provide guidance for trademark and patent law enforcement activities. Handle, mediate, and resolve IP disputes and assist in safeguarding IP rights. Ensure the protection of exhibition trademarks, patents, geographical indications of origin, and other relevant IP assets.
4. Draft and implement policy measures to promote the creation, application, and management of IP. Facilitate the transfer and transformation of IP assets. Regulate the IP trading market.
5. Accept and process trademark and patent applications. Collect applicable fees and provide inquiry and consultation services in accordance with governing rules. Develop statistics, conduct analysis, and generate reports on trademarks and patents. Maintain a list of key protected trademarks and oversee the declaration of products with geographical indications of origin.
6. Establish an IP public service system. Build and manage an IP information public service platform that benefits enterprises and the public, fostering interconnectivity. Promote the dissemination and utilization of IP information. Collaborate with relevant departments to implement early warning systems for IP risks.
7. Formulate policies related to foreign IP matters. Conduct research on international IP developments. Organize and coordinate foreign-related IP affairs. Facilitate international contacts, cooperation, and exchange activities related to IP. Undertake relevant matters concerning Hong Kong, Macao, and Taiwan. Promote the collection of international IP resources.
8. Provide guidance for the development of trademark and patent intermediary service agencies. Organize the drafting of administrative measures to regulate these agencies and supervise and guide relevant industry associations in their operations.
9. Organize and conduct public awareness campaigns and educational programs on IP laws, regulations, and policies. Coordinate the drafting of IP education and training plans and ensure their implementation. Promote the construction of an IP talent team.
10. Fulfill any additional tasks assigned by the CPC Shanghai Municipal Committee and Shanghai Municipal People’s Government.
