Main responsibilities of the Shanghai Municipal Commission of Commerce (Shanghai Municipal Office for Port Services) are as follows:
1. Implement laws, regulations, rules, guidelines, and policies pertaining to domestic and foreign trade, foreign investment, foreign economic cooperation, and port services. Conduct research and draft local regulations and rules on these subjects, formulate relevant policies, and ensure their effective implementation.
2. Lead the formulation of construction plans and development strategies for Shanghai as an international trade center. Coordinate and enhance the efforts to establish Shanghai as a prominent hub for international trade. Develop strategies, planning programs, standards, and measures to promote domestic and foreign trade, foreign investment, foreign economic cooperation, and port services, and oversee their implementation.
3. Drive the construction of modern market systems and assume responsibility for managing the spot commodity market. Foster the growth of trade headquarters and collaborate with relevant departments to promote innovation and application of supply-chain solutions. Take a leading role in advancing the development of the platform economy. Promote modern logistics and contribute to the establishment of a robust recycling system for renewable resources according to the allocated responsibilities. Oversee the management of the automobile sales, used car circulation, and abandoned vehicle dismantling industries according to the allocated responsibilities. Support brand development in the fields of commerce and trade, and facilitate the reform and innovation of time-honored brands.
4. Drive the development of credit systems in the commerce sector, enhancing the consumer environment and establishing a public service platform for business credit. Facilitate the implementation of classified supervision based on business credit and guide the sale of business credits. Lead the establishment of a coordinated supervision mechanism for single-purpose prepaid consumer cards, ensuring effective oversight and providing related services. Manage the drug distribution industry.
5. Organize and regulate important consumer markets and oversee the circulation of crucial production materials. Establish a comprehensive emergency response mechanism to address the supply of essential daily necessities in the market. Take responsibility for managing reserves of key commodities and regulating market operations within the designated scope. Supervise the distribution of edible agricultural products, establish a traceability system for important products, foster the growth and development of the aquatic product market, and formulate plans and strategies for the distribution of liquor and alcoholic beverages. Promote the construction of modern rural market systems and implement projects to establish efficient circulation networks in rural areas.
6. Promote the development of commerce and trade, advance modern circulation methods, and stimulate consumption growth. Guide and coordinate the planning of commodity trading markets and the layout of commercial networks. Implement and improve safe production responsibility systems in the commerce sector, providing guidance, coordination, supervision, and management of safe production efforts. Foster the development of chain operations, commercial franchises, and other modern circulation methods, while promoting consumption in the commerce and trade sectors. Oversee commercial operations and management, and analyze macro-level commercial and trade conditions.
7. Drive the growth of the life service industry, enhance the statistical monitoring system, and foster innovative development modes. Manage life services within its scope of responsibility. Oversee the auction industry in accordance with regulatory guidelines. Promote the establishment of modern service clusters.
8. Lead the development and promotion of e-commerce, drive innovation in commerce and trade circulation models, facilitate the adoption of new technologies in the field of commerce and foster digital business. Organize and implement e-commerce demonstration projects, promote the construction of an e-commerce public service system, and conduct statistical monitoring of e-commerce activities.
9. Guide the structural adjustment of imports and exports, promote the establishment of a goods trade promotion system, coordinate and enhance trade facilitation efforts, and support the entry of outstanding brands into domestic and international markets. Take the lead in promoting the development of cross-border e-commerce. Develop statistics and monitoring systems for the import and export of goods. Manage the importation of significant industrial products, licenses for specific import and export commodities, and export quotas for commodities excluding grain, cotton, and coal. Oversee the import and export of machinery, electrical products, complete equipment, high-tech products, and other related items. Supervise the import and export of dual-purpose articles and technologies within its purview.
10. Facilitate the development of the service trade promotion system, key service trade areas, service outsourcing, and other major models. Establish an international public platform for technology import and export trading. Manage technology import and export, service outsourcing, software export, international freight forwarding, and other related industries within its purview. Collaborate with relevant departments to promote innovation in emerging service trade fields. Develop statistics and monitoring systems for service trade operations.
11. Formulate and collaborate with relevant departments to implement comprehensive response plans following China’s accession to the WTO. Establish a fair trade early-warning mechanism for regional import and export activities. Guide and coordinate efforts in anti-dumping and anti-subsidy measures for exports. Participate in organizing investigations on industrial damages and mediating and settling major foreign economic and trade disputes. Ensure trade policy compliance and undertake work related to intellectual property rights (IPRs) in foreign trade.
12. Guide foreign investment in Shanghai and coordinate the promotion, approval, and record management of foreign-invested enterprises. Provide guidance for foreign investment in development zones and national economic and technological development zones. Review, approve, and record the establishment and changes of foreign-invested enterprises. Offer policy consultations and coordinated services for foreign-invested enterprises within its authority.
13. Establish an economic statistical index system and credit rating system for the Meetings, Incentives, Conferences, and Exhibitions (MICE) industry. Improve the environment for the MICE industry and promote its integration with other related sectors. Manage international economic and trade exhibitions and support the development of key brand exhibitions. Coordinate various urban guarantees for large-scale exhibitions such as the China International Import Expo (CIIE).
14. Supervise foreign economic cooperation and implement relevant matters related to foreign economic cooperation and foreign aid in accordance with regulations. Record and manage overseas startups by companies based in Shanghai, excluding financial institutions, in compliance with applicable laws. Guide and promote overseas project contracting, labor export cooperation, overseas employment, and other relevant work of companies based in Shanghai. Take the lead in protecting the rights and interests of personnel assigned or employed to work overseas. Host and participate in multilateral and bilateral trade and economic negotiations, and contribute to handling economic relations with other countries and regions within the national strategic planning framework for foreign economic cooperation.
15. Conduct preliminary reviews of new port openings, expansions of existing ports, temporary port openings, and temporary entry and exit to and from non-open areas, and submit them for approval. Review, inspect, accept, and submit for approval the opening and enabling of newly established, rebuilt, and expanded wharves, terminals, stations, and other foreign-related operational areas within the designated opening range. Review and approve temporary access to the opening range, and take the lead in organizing the preparation for inspections and acceptance of newly established or expanded special controlled areas. Coordinate and supervise the planning, design, investment, and construction of supporting facilities for entry checkpoints, and coordinate the planning and construction of supporting facilities for inspections in special controlled areas.
16. Coordinate and facilitate customs clearance procedures at entry ports, promote collaboration and cooperation among port inspection units, and explore innovative supervision models. Ensure efficient customs clearance services for major events such as important international conferences, major international competitions, and large-scale international exhibitions. Participate in port safety coordination efforts and address issues faced by port inspection units in coordination with the local government.
17. Coordinate and drive the digitalization of customs clearance supervision at entry ports and special controlled areas, and provide statistical analysis and release of port operation data.
18. Organize and oversee significant trade and economic activities related to foreign affairs. Review, approve, and manage non-corporate economic organizations’ representative offices from foreign countries, Hong Kong, Macao, and Taiwan based in Shanghai. Foster investment promotion and trade and economic cooperation between Shanghai and Hong Kong, Macao, and Taiwan, and handle trade and economic affairs related to Taiwan.
19. Guide and supervise the work of relevant social intermediaries and social organizations in the commerce and port sectors, coordinate talent development in these fields, and organize foreign outreach efforts.
20. Carry out additional tasks as assigned by the CPC Shanghai Municipal Committee and Shanghai Municipal People’s Government.
