Shanghai Municipal Administration for Market Regulation
Main responsibilities are as follows:
1. Provide comprehensive market supervision and administration. Enforce laws, regulations, rules, policies, and standards related to market supervision and administration. Conduct research and develop local regulations and rules drafts for market supervision and administration. Formulate policies and plans and oversee their implementation. Implement national strategies such as quality power strategy, food safety strategy, and standardization strategy. Uphold market order and foster an environment of honesty, trustworthiness, and fair competition. Conduct investigations and research on the establishment of a new market supervision and administration system in an open economy. Coordinate and address major issues in relevant areas.
2. Facilitate the registration of market entities. Organize and guide the registration process for various entities, including enterprises, farmers’ professional cooperatives, units engaged in business activities, individual businesses, and Shanghai-based representative offices of foreign or regional enterprises. Establish and enhance an enterprise name approval system. Approve and issue business licenses and relevant permits to eligible market entities. Develop and implement administrative licensing measures for food-related products, ensuring compliance with such measures. Organize the work related to production permits for food-related products.
3. Organize and provide guidance for comprehensive law enforcement activities related to market supervision and administration. Facilitate the establishment and development of district-level comprehensive market supervision and administration law enforcement teams. Drive reforms in the comprehensive law enforcement system for market supervision and administration in ment with relevant requirements. Ensure unified and comprehensive market supervision and administration. Coordinate and oversee the investigation and handling of significant illegal cases within the domain of market supervision and administration, while supervising the progress of major cases. Regulate administrative law enforcement practices pertaining to market supervision and administration.
4. Implement anti-monopoly laws. Promote the adoption of competition policies and facilitate the implementation of a fair competition review system. Carry out enforcement activities related to anti-monopoly laws, such as addressing monopoly agreements, market dominance abuses, abuses of administrative power, and activities that restrict competition, within the scope of authorization from the state and in accordance with the law. Offer assistance and guidance to enterprises in responding to anti-monopoly lawsuits abroad.
5. Supervise and administer market order. Carry out supervision and administration of market transactions, online commodity transactions, and relevant service activities in accordance with the law. Organize and guide investigations and actions against illegal pricing and charges, unfair competition, illegal direct selling, pyramid schemes, illegal advertising, trademark and patent IP rights infringement, and the production and sale of counterfeit goods. Oversee and administer various consumer goods markets, production materials markets and more. Develop a contract supervision and management system with specific measures. Enforce the supervision and administration of contract and auction activities in accordance with the law, and manage the registration of personal property collateral. Establish development plans and professional standards for the advertising industry and oversee advertisement management activities. Organize investigations and actions against unlicensed production and operation, as well as other relevant unauthorized production and operation activities.
6. Provide guidance to consumer protection committees in safeguarding consumer rights. Formulate relevant rules and regulations to protect the legitimate rights and interests of consumers and improve the consumer rights protection system. Monitor the creditworthiness of market entities. Establish an information publicity and sharing mechanism for market entities, legally publish and share relevant information, and collaborate with relevant departments in constructing a credit system for market entities and implementing joint punishments.
7. Conduct macro quality management. Develop and implement quality development systems and measures. Organize efforts for quality and technology breakthroughs, and enhance overall planning for collaborative services and the application of quality infrastructure. Promote civil-military integration in relevant fields and establish an effective quality development working system. Ensure that enterprises fulfill their primary responsibilities for product quality. Support the implementation of brand development strategies and prepare and publish quality condition analysis reports. Organize the implementation of a recall system for defective products and supervise and administer product anti-counterfeiting initiatives.
8. Supervise and administer product quality and safety. Manage the monitoring of product quality and safety risks, including the development of a list of key products for quality monitoring. Strengthen monitoring efforts for product quality and safety risks and organize supervision and random checks of product quality. Establish and implement a quality grading system and a quality and safety traceability system. Manage production permits for industrial products. Provide guidance for the supervision and inspection of the quality of fibers and fiber products.
9. Supervise and administer the quality and safety of special equipment. Oversee the comprehensive management, organization, and coordination of quality supervision for special equipment. Monitor the implementation of energy-saving standards for high-energy-consumption special equipment and environmental protection standards for boilers. Organize investigations and actions related to special equipment accidents, conduct statistical analysis, and regularly disclose comprehensive information on special equipment safety to the public within the scope of authority.
10. Coordinate comprehensive food safety supervision and administration. Organize the formulation and implementation of food safety plans and major policies, and enhance the food safety traceability system. Establish a food safety emergency response system and provide guidance for emergency management and response to food safety incidents. Establish a unified system for food safety information disclosure. Promote and enhance coordination and cooperation mechanisms for food safety across regions and departments.
11. Supervise and administer food safety. Establish and implement a comprehensive supervision and inspection system covering the entire process of food production, distribution, and consumption, along with mechanisms for identifying and controlling hidden hazards. Organize and conduct food safety supervision, including random inspections, risk monitoring, verification and disposal, risk early warning, and information exchange. Oversee the supervision and administration of the production and processing quality of special foods and food-related products.
12. Supervise and administer metrology work. Implement national legal units of measurement and the national measurement system. Organize the establishment and management of metrological benchmarks and social public measurement standards across the city. Oversee the formulation (modification), review, approval, and issuance of local metrological verification procedures and technical specifications. Manage measuring instruments, including their calibration and comparison, and regulate and supervise quantity measurement of goods and market measurement practices.
13. Manage standardization activities. Organize the preparation and implementation of a standardization development strategy and governmental guidance policies and measures for standardization. Promote the work related to “Shanghai Standards.” Facilitate the implementation of national, industry, and local standards. Promote international standardization activities and adoption of international and advanced overseas standards. Organize the formulation (modification), review, approval, and issuance of local standards.
14. Supervise and administer inspection and testing activities. Regulate inspection and testing markets and foster the reform and development of the inspection and testing industry. Enhance the inspection and testing system and improve the capabilities and internationalization of technology agencies involved in market supervision and administration.
15. Supervise, administer, and coordinate certification and accreditation work comprehensively. Organize and implement a national unified system for certification, accreditation, and conformity assessment supervision and administration. Encourage and guide various organizations to develop management systems and voluntary product certifications. Maintain records of certification bodies and supervise and manage certification activities.
16. Foster the development of technology and informatization in market supervision and administration. Promote the establishment of a standardized public information service system and ensure the timely release of government affairs-related news and announcements. Facilitate international exchange and cooperation, including conducting notifications and consultations related to the Agreement on Technical Barriers to Trade of the World Trade Organization.
17. Supervise and administer energy measurement in key energy-consuming units. Promote energy measurement practices and support green development initiatives. Organize the formulation (modification) of local energy-saving and environmental protection standards, as well as the implementation of an energy efficiency label management system.
18. Manage the Shanghai Municipal Drug Administration and Shanghai Intellectual Property Administration.
19. Carry out any additional tasks assigned by the CPC Shanghai Municipal Committee and Shanghai Municipal People’s Government.
