Legal Basis
According to Article 19 of the Road Traffic Safety Law of the Peoples Republic of China (as published at the 5th Session of the Standing Committee of the Tenth National Peoples Congress on October 28, 2003; revised for the first time by the Decision on Amending the Road Traffic Safety Law of the Peoples Republic of China adopted at the 31st Session of the Standing Committee of the Tenth National Peoples Congress on December 29, 2007; revised for the second time by the Decision on Amending the Road Traffic Safety Law of the Peoples Republic of China adopted at the 20th Session of the Standing Committee of the Eleventh National Peoples Congress of the Peoples Republic of China on April 22, 2011), whoever drives a motor vehicle shall have lawfully obtained a motor vehicle driving license. Whoever applies for a motor vehicle driving license shall meet the conditions for driving permission as prescribed by the public security institution under the State Council; after he is found upon examination be qualified, the traffic administrative department of the public security organ shall issue a motor vehicle driving license of the corresponding category.

The applicant may apply at the business window at the Substation I, Vehicle Management Station of Traffic Police Headquarters of Shanghai Municipal Public Security Bureau (No. 2999, West Huaxia Road). After the policemen accept, review and approves the application, the applicant can make a reservation for examinations. Those who pass the examinations will be granted the driving license on the spot. Online reservation is available on the Yiwangtongban general portal (http://zwdt.sh.gov.cn/govPortals/index.do) and the Suishenban APP.

Question: What do the identity certificates refer to?
Answer: 1. For an organ, enterprise, institution or social organization, the identity certificates refer to the Organization Code Certificate, the power of attorney affixed with its official seal, and the identity certificate of the agent holding such power of attorney. If the owner of the motor vehicle is an internal organization of the unit and does not met the conditions to receive the Organization Code Certificate, the Organization Code Certificate of the superior unit can be used as the identity certificate of the owner of the motor vehicle. If the unit has been canceled, revoked or gone bankrupt, and its motor vehicle needs to go through the procedures of registration change, registration transfer, cancellation of mortgage registration, de-registration, cancellation of pledge registration, application for motor vehicle registration certificate, and replacement or renewal of motor vehicle registration certificate, license plate and driving license, the cancellation certificate issued by the administrative department for industry and commerce can be used as the identity certificate of the unit that has been canceled. For an organ, institution or social organization which has been revoked, the identity certificate refers to the certificate issued by the superior administration. For an enterprise which has gone bankrupt, the identity certificate refers to the certificate issued by a legally formed liquidation institution; 2. For a foreign embassy or consulate in China, a foreign office in China, or a representative office of an international organization in China, the identity certificate refers to the certificate issued by the embassy or consulate, the foreign office or the representative office; for a Chinese resident, the identity certificate refers to the Resident Identity Card or the Temporary Resident Identity Card. For a resident temporarily residing in the Chinese Mainland, the identity certificates refer to the Resident Identity Card or the Temporary Resident Identity Card and the certificate of residence or temporary residence issued by the public security organ; 4. The identity certificate of a soldier in active service (including an armed policeman) refers to the Resident Identity Card or the Temporary Resident Identity Card. Before the Resident Identity Card is obtained, the identity certificates refer to the Military ID, the Civil Official ID, the Certificate of Soldiers, the Certificate of Special Retirement, the Certificate of Retirement or any other valid military identity certificate as issued by a relevant department of the army, and his or her domicile certificate as issued by an entity at or above the regimental level where he or she serves; 5. the identity certificates of a resident in Hong Kong or Macao Special Administrative Region refer to the Mainland Travel Permit for Hong Kong and Macao Residents or theTravel Permit of the Peoples Republic of China, the Identity Card of Residents of Hong Kong or Macao Special Administrative Region and the accommodation registration certificate issued by the public security organ; 6. the identity certificates of a resident in Taiwan region refer to the Mainland Travel Permit for Taiwan Residents valid for more than six months which is issued by the public security organ or the Travel Permit of the Peoples Republic of China issued by the Ministry of Foreign Affairs and the accommodation registration certificate issued by the public security organ; 7. the identity certificates of an overseas Chinese shall be the Passport of the Peoples Republic of China and the accommodation registration certificate issued by the public security organ; 8. the identity certificates of a foreigner means the passport or any other travel certificate he or she holds at the time of entry, the valid visa or certificate of residence or stay with a period of residence (stay) for six months or more, and the accommodation registration certificate issued by the public security organ; and 9. The identity certificate of a person working in a foreign embassy or consulate in China or a representative office of an international organization in China refers to the valid identity certificate issued by the Ministry of Foreign Affairs.
